I am not a lawyer, so this might be completely wrong but I think this statement is in complete contrast to this one: 

 

There has been a lot of conversation about the use of the TM symbol, all lawyers explain that it is important to write it… to avoid in the future OpenID become a word like "kleenex", "email"…

If you don't enforce the correct use of the logo, wording,... it will become open to use for everybody the way they want it to use. It will be as common as RSS or SSL which won't be bad, by the way. See Hans' email.
