>It's probably just as interesting that they're now owned by MTV:
What concerns me is section 16c in their Terms of Use, which
basically seems to amount to perpetual ownership of all content the
user submits - they're trying to monetize the users! Fair enough if
they're paying for the hosting of this content, but look at that
second paragraph:
http://www.socialproject.com/TermsOfUse.html#paragraph18_3
Imagine that you publish a podcast under the name "Chris Messina",
with your logo (you've trademarked it, everything) in the corner.
Later on, they decide that your good reputation is harmful to their
corporate interests (people place value in what you say, who'd've
thought it?), and splice together some of your clips with some of
their own material to make you look bad. To give it that authentic
feel, though, they put your logo on it and say it was created by
"Chris Messina"!
Can they do that? The way I'm reading their Terms, they sure can.
After all, they just want to "use and refer to your name, logo" in a
"presentation" to "exploit" their "rights" (all quotes are taken from
that actual paragraph).
If someone more skilled in legalese has a less frightening
interpretation of that, I'd love to hear it. In any case, I don't
think that their approach to user-generated content is very
user-centric :(
